Intellectual Property Rights Distribution
The "Mort and Retardio" project employs a unique framework for distributing intellectual property (IP) rights through the use of blockchain technology, ensuring transparency and equitable participation for all stakeholders involved.
SBT Holders: Holders of Soul Bound Tokens (SBTs) are granted specific rights and privileges concerning the intellectual property of the "Mort and Retardio" universe. These rights are predefined and encoded within the metadata of each SBT, enabling holders to introduce and monetize digital assets, participate in governance, and receive a share of revenues generated from asset sales and royalties.
The Company: As the initiator and primary facilitator of the "Mort and Retardio" universe, the company retains overarching rights to the IP, overseeing the strategic direction and maintaining the core integrity of the brand. The company also holds the rights to the initial set of assets used in the brand's development and manages the broader commercial rights to ensure brand consistency and legal compliance.
Commercial Use and Limitations
To maintain the integrity of the "Mort and Retardio" universe and to protect the rights of all participants, specific limitations and permissions are set concerning the commercial use of the IP:
Limited Commercial Use: SBT holders are granted the ability to use the Mort and Retardio IP for certain commercial purposes, but this is contingent on owning the underlying digital assets that compose this IP. Simply holding an SBT does not automatically grant unlimited commercial rights.
Asset Ownership and Commercial Rights: Upon the launch of the marketplace, all assets used by the company since the brand's inception will be tokenized and owned by the company. SBT holders can acquire commercial rights by purchasing these assets from the marketplace, after which they can utilize them for commercial purposes.
Proof-of-Rights Mechanism: This innovative mechanism allows SBT holders to act as validators, verifying the rights for digital assets to be incorporated into the official IP library. This process ensures that only approved and rights-cleared assets are used commercially, maintaining the brand’s legal integrity and creative direction.
Rights of Contributors
Contributors, such as artists, game developers, and other content creators, play a crucial role in enriching the "Mort and Retardio" universe. Their participation is facilitated and rewarded under clearly defined terms:
Creation and Monetization: Contributors can create digital assets and submit them to the marketplace. If approved by SBT holders, these assets can be monetized through sales and auctions.
Revenue Sharing: Contributors receive a significant percentage of the revenue from the initial sale of their assets and ongoing royalties, incentivizing high-quality and innovative contributions.
Limited Rights: While contributors have the opportunity to monetize their creations, their rights are more restricted compared to SBT holders. They do not hold rights to the broader IP but can earn from the specific assets they create.
The structured distribution of rights and ownership within the "Mort and Retardio" project ensures a balanced ecosystem where creativity is rewarded, IP rights are protected, and all stakeholders have clear incentives to contribute to the project’s success.
